2. The Competition
2.1 These terms and conditions apply to all Competitions listed on the Promoter’s Website at www.topdogcompetitions.ie (the “Website”) and the TOP DOG Competitions mobile app (“the App”).
2.2 All Competitions are skill-based Competitions. To be in with a chance of winning, everyone who enters the Competition (an “Entrant”) will be required to correctly answer a question set by the Promoter (the “Competition Question”) or some other test of skill as set out by the Promotor.
2.3 All Competitions take place over a set time period. The starting time and date and the time and dates will be specified in each Competition Listing on the Website and/or App. These dates shall be referred to as the “Opening Date” and “Closing Date” respectively. All times and dates listed are at GMT (Greenwich Mean Time). The remaining time to a Competition starting and once commenced the remaining time left in a Competition will be defined by a count down clock displayed in each Competition Listing.
2.4 A Competition Closing Date will not be extended unless failure to do so would impede fairness (due to, but not limited to technical or equipment failure on behalf of the Promotor) and in those circumstances, The Promoter reserves the right to extend the Closing Dates of any Competition. If the Promoter does extend the Closing Dates of any Competition, the new details will be displayed on the Website and/or the App.
2.5 Poor entry or uptake will not be deemed a factor to extend a Competition. Once a Competition has started, it will continue until either the maximum number of entries have been reached or the Competition closing date has been reached. If the maximum number of entries has not been reached by the Closing Date, then a winner will be drawn from the eligible entrants who have successfully entered the Competition.
3. Competition Entries:
3.1 All Competitions will have a limited number of entries. The maximum number of entries will be detailed in the Competition Listing on the Website and/or the App.
3.2 An entry fee is payable each time you enter through the Website or the App. Postal entries are free.
3.3 Entrants can enter the Competition as many times as they wish until the maximum number of entries have been received.
3.4 The Promoter will not accept Competition entries that are:
(a) automatically generated by computer
3.5 All Competition entries must be received by the Promoter no later than the Competition completion time on the Closing Date as specified in the Competition Listing. Any Competition entries received after the specified time on the Closing Date or if the maximum number of entries for draw entered has been reached, whichever comes first are automatically disqualified and will not be entered into the random draw.
3.6 Instructions on how to enter the Competition:
(a) go to the Website or App, choose the Competition you wish to enter and read the Competition question.
(b) Answer the question correctly, the onus is on the entrant to ensure that their answer is correct, incorrect answers will not be entered into the Competition, but your entry fee will be collected.
(c) Choose the number of entries you wish to purchase and click the “Participate now” button. Then go to your basket and click the “checkout” button.
(d) Complete the entry form, create an account by choosing a username and password, accept the terms and conditions by checking the box and click the “place order” button, you will then be transferred to our secure payment gateway where you can pay for your entries using VISA or Mastercard.
(e) The Promoter will send confirmation that your entry has been received and confirmation of your ticket number should your answer be correct. Should your answer be incorrect, you will receive an email informing you that your answer is incorrect and you will not be issued a ticket number. You are free to enter the competition again by following the steps in (a) to (d) above.
(f) There is an option to enter any Competition for free (subject to any limit placed on entries by the Promoter), to enter for free, first you must register an account with TOP DOG Competitions, then send your entry on a plain open postcard to the following address:

The following information must be included with your entry:
(i) your full name
(ii) your address
(iii) a contact telephone number and email address
(iv) your date of birth and a signed declaration that you are over 18 years of age
(v) The correct title of the Competition you wish to enter.
(vi) your answer to the Competition Question.
3.7 Each free entry must be submitted and posted separately. Bulk entries in one envelope will not be accepted, even if those entries are for different Competitions.
3.8 The Promoter will not accept responsibility for Competition entries not received or that are not fully completed regardless of cause, including, but not limited to, equipment failure, technical malfunction or software failure of any kind.
3.9 The Promoter will not acknowledge receipt of postal entries nor confirm if your answer to the Competition Question is correct.
3.10 By purchasing entries and submitting a Competition entry, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions and/or any future update to these terms and conditions.
4. Choosing a winner
4.1 All Entrants who correctly answer the Competition Question will be placed into a draw and the winner will be chosen by random draw. The random draw will take place as soon as reasonably possible or at the latest, within 7 days of the Closing Date (“Draw Date”).
4.2 To ensure transparency, the random draw will take place online within a public forum for all entrants and/or others to view.
4.3 The Promotor will use an independent, verified random number generator to select the winner from each draw.

5.1 The Competition is run in the jurisdiction (“the jurisdiction”) of the Republic of Ireland in accordance with the Gaming and Lotteries Act 1956 and the Gaming and Lotteries Act (Amendment) 2019. The Competition is open to all residents in Ireland and the United Kingdom who are aged 18 years or over, except:
(a) employees of the Promoter;
(b) employees of agents of the Promoter, who are professionally connected with the Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
5.2 We do not represent that the content available on or through our site is appropriate for use or available in other locations. By entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win.
5.3 If you enter the Competition from outside the jurisdiction, then the onus is on you to confirm that you are eligible to enter. The Promoter may require you to provide proof that you are eligible to enter the Competition. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the Competition.
5.4 The promotor will not be responsible for any tax, duties or other fees payable for importing any prize into another jurisdiction.
5.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize Competition.
6.1 No refunds of the entry fee will be given in any event, including but not limited to:
(a) If, following your entry into the Competition, you subsequently find out that you are not eligible to enter the Competition or claim the Prize.
(b) If, following your entry into the Competition the eligibility criteria for entering the Competition or claiming the Prize changes through actions outside the control of the Promotor including but not limited to changes in legislation and you are no longer eligible.
(c) If you are disqualified from the Competition by the Promoter for any reason.
(d) The entrant’s answer to the Competition Question is incorrect.
6.2 In the event that a Competition must be cancelled, due to negligence by the Promoter then the Promoter will refund any entry fees paid to enter that Competition.
7. The prize
7.1 The prize for the Competition is described on the Website and/or App (the “Prize”). Details of the Prize are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date.
7.2 The Promoter reserves the right to substitute the prize with a prize of equal or greater value or a cash alternative of equal or greater value. If any details of the Prize changes, the Promoter will endeavour to update the Website and/or App as soon as reasonably possible.
7.3 While every effort is made to ensure that the details listed on the Website and/or App are correct, The Promoter makes no representations and gives no warranties about the Prize.
7.4 The Prize may be supplied by a third-party supplier (the “Supplier”). Details of the Supplier (if any) will be provided in the Competition Listing on the Website and/or the App.
7.5 Unless specifically stated in the Competition Listing or deemed necessary by the Promotor, there is no cash alternative for the prize.
8.1 The decision of the Promoter is final, and no correspondence or discussion will be entered into.
8.2 The Promoter will contact the winner personally as soon as practicable after the draw date, using the telephone number or email address provided with the Competition entry. If the winner cannot be contacted or is not available, or has not claimed the Prize within 30 of days of the draw date, the Promoter reserves the right to re-offer the Prize for selection from the original pool of Competition entrants whom submitted correct entries to that Competition that were received before the Closing Date.
8.3 In accordance with the Act, the Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners to anyone who writes to the address set out in clause 1 (enclosing a self-addressed envelope) within one month after the Closing Date of the Competition.
8.4 If you object to any or all of your details and winning entry being published or made available, please contact the Promoter at email@example.com prior to the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority upon request.
9. Claiming the prize
9.1 All prizes will be available for collection or delivery (as detailed in the Competition Listing on the Website and/or App) 48 hours after the completion of the Competition draw.
9.2 You must claim the Prize personally. The Prize may not be claimed by, collected by or delivered to a third party on your behalf.
9.3 If your personal details, including contact information, changes at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to firstname.lastname@example.org. Notifications must include details of the Competition you have entered, your old details and your new details.
9.4 The Promoter will contact the winner of any Cash Prize and will transfer the winning amount directly to the bank details as supplied by the winner. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 30 days will result in disqualification from the Competition and the winner forfeiting the prize. In such circumstances, the Promoter reserves the right to re-offer the Prize for selection from the original pool of Competition entrants who submitted correct entries to that Competition that were received before the Closing Date.
9.5 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.
10. Limitation of liability
10.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize. Your statutory rights are not affected.
10.2 The content on our Website and/or App is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Website and/or App.
10.3 Although we make reasonable efforts to update the information on our Website and/or App, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.
10.4 There maybe links to third party Websites on our Website and/or App contains. Such links should not be interpreted as approval by us of those linked Websites or information you may obtain from them. We have no control over the contents of those sites or resources.
10.5 Our Website and/or App may include information and materials uploaded by other users of the site, including posts made to our social media accounts. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.
10.6 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our Website and/or App, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
11. Customer Accounts
11.1 If you choose to have, or you are provided with, a user Account:
11.2 You must keep your account details, identification code, password or any other piece of information safe, you must treat such information as confidential.
11.4 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at email@example.com.
12. Data protection and publicity
12.2 If you are the winner of the Competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this Competition. You further agree to participate in any reasonable publicity required by the Promoter.
12.3 If you do not wish to participate in any publicity, you must notify the Promoter prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the Competition, we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the Competition has been properly administered and the Prize awarded.
12.4 If you are the winner of the Competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the Competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to re-offer the Prize for selection from the original pool of Competition entrants who submitted correct entries to that Competition that were received before the Closing Date.
12.5 Please note that under the Data Protection Act you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request, you will be withdrawing from any Competition(s) that you may have entered as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the Competition.
12.6 If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at firstname.lastname@example.org prior to the Closing Date.
13. Licences and Uses
13.1 We are the owner or the licensee of all intellectual property rights in our Website and App, and to all and any material published on them. Those works are protected by copyright laws and all such rights are reserved.
13.2 We only provide our Website and/or App for domestic and private use. No person or organisation may use our Website and/or App for any commercial or business purposes, and we have no liability for any losses of profit, loss of business, business interruption, or loss of business opportunity incurred in doing so.
13.3 Any person may print off one copy, and may download extracts, of any page(s) from our Website and/or App for personal use and may draw the attention of others to content posted on our site.
13.4 No person or organisation may modify in any way digital copies of any materials or paper copies of material printed from the Website and or App in order to present any representation other than those actually represented on our Website and/or App.
13.5 No person or organisation may use any part of the content on our Website and/or App for commercial purposes without obtaining a licence to do so from the Promoter.
13.6 Any person or organisation who attempts to or does print off, copy or download any part of our Website or App outside of 13.4 above will be in breach of these terms and conditions and their right to use our Website and/or App will cease immediately.
13.7 No person or organisation may misuse our Website or App by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. No person or organisation may attempt to gain unauthorised access to our Website and/or App, the server on which our Website and App is stored or any server, computer or database connected to our Website and/or App. No person or organisation may attack our Website or App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision such people or organisations will be committing a criminal offence under the Criminal Damage Act, 1991 and/or Section 9 of the Criminal Justice (Theft and Fraud) Offences Act 2001 and/or the European Convention of Cybercrime. This company will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website and App will cease immediately.
14.1 By entering any Competition on the Website and/or app constitutes the Entrant’s acceptance of these terms and conditions.
14.2The Promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be displayed on the Website and App.
14.3 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any Entrant from participating in any Competition.
14.5 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize Competition where it becomes necessary to do so.
14.6 The Competitions on the Website and/or App are in no way sponsored, endorsed, administered by or associated with Facebook. By entering the Competitions, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the Competitions.
14.7 We do not guarantee that our Website and/or App, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Website and/or App for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
14.8 These terms and conditions shall be governed by Irish law, and all parties submit to the exclusive jurisdiction of the courts of Ireland.
